Privacy Policy
Draft for review. This policy is written to the Australian Privacy Principles and is ready to publish once the highlighted business details are filled in and it has been checked by your legal adviser. Placeholders are marked in gold.
Who this covers
Digiton Logistics (ABN 50 664 924 163), referred to below as "Digiton", "we" and "us". We are an Australian owned transport logistics carrier providing linehaul and regional freight services.
Businesses with an annual turnover of $3 million or less are generally exempt from the Privacy Act 1988 (Cth). Digiton has chosen to handle personal information in line with the Australian Privacy Principles regardless of whether that exemption applies to us, because our customers and their customers are entitled to know how their information is treated.
What we collect
We only collect personal information that we actually need to move freight and to run the business. In practice that is:
- Contact details for the people we deal with at customer, consignor and consignee sites: name, business email address, business phone number, and the site address.
- Consignment information that identifies a delivery: reference numbers, pickup and delivery addresses, times, and any special handling or access instructions.
- Proof of delivery, which may include the name and signature of the person who received the freight.
- Driver and personnel records for our own team: licence class and expiry, qualifications, medical and fatigue records, and the records we are required to keep under heavy vehicle law.
- Enquiries you send us, including anything you choose to put in an email to us.
We do not collect sensitive information as defined in the Privacy Act, other than the health information that heavy vehicle driver medical requirements oblige us to hold for our own drivers.
What this website collects
This website does not use advertising trackers, third party analytics, cookies or embedded social media. Fonts and images are served from our own domain rather than from a third party content network, so loading a page does not disclose your visit to anyone else.
Our hosting provider keeps standard server logs, which include IP addresses, for security and troubleshooting. Confirm hosting provider and log retention period.
Why we collect it, and what we do with it
- To quote, plan, carry and deliver freight.
- To keep you informed about a consignment in transit, which is the core of how we operate.
- To meet our obligations under the Heavy Vehicle National Law, including Chain of Responsibility duties, fatigue management and mass and dimension compliance.
- To invoice, collect payment and keep the financial records the law requires.
- To investigate an incident, a claim or a complaint.
We do not sell personal information. We do not use it for marketing unrelated to freight, and we do not disclose the identity of our customers to other customers.
Who we disclose it to
We disclose personal information only where it is necessary to do the job or where the law requires it. That means:
- The consignor and consignee for a given load, so the freight can be collected and received.
- Prime contractors and carriers we subcontract to or for, limited to the information needed for that consignment.
- Our insurers and professional advisers where a claim or dispute arises.
- Regulators and enforcement agencies where we are required or authorised by law to do so, including the National Heavy Vehicle Regulator and state road authorities.
We do not routinely disclose personal information to overseas recipients. If any system used by the business stores data offshore, name the countries here.
How we protect it
We hold personal information in access controlled business systems and in paper records where operational documents require it. We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure, including limiting access to staff who need it for their role.
We keep records for as long as we need them for the purpose we collected them, and for as long as the law requires, then we destroy or de-identify them. Heavy vehicle work diaries, fatigue records and mass records are kept for the periods set by the Heavy Vehicle National Law.
Accessing and correcting your information
You can ask us what personal information we hold about you and ask us to correct it. Email admin@digitonlogistics.com.au with enough detail for us to find the record.
We will respond within 30 days. There is no charge for making a request. If we refuse access or refuse to make a correction, we will tell you why in writing and explain how to complain.
Complaints
If you think we have mishandled your personal information, email admin@digitonlogistics.com.au and mark it as a privacy complaint. We will acknowledge it within five business days and give you a written response within 30 days.
If you are not satisfied with our response, you can take the complaint to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
Changes to this policy
We review this policy at least once a year. The review date at the top of the page is the current version. If we make a material change we will note it here.
